Terms and Conditions

Object

The sending of the order by the Customer implies that he has read these terms and conditions and accepts them without any reservation. All information available on the site are indicative only. The Company "BRASE ARC" online store "FLAKESRESIN" can modify them at any time without notice.

Order Confirmation

The contractual information will be confirmed via email to the address specified by the Customer.

Proof of the transaction

The records stored in computer systems www.flakesresin.com in a reasonable conditions of safety are considered proof of communications, orders and payments between the parties.

The filing of purchase orders and invoices is made on a reliable and durable support and can be produced as evidence.

Orders

Once products are selected and your identification data indicated, then choose your method of payment. A summary of your order is introduced to you, including information on products, prices, or the terms of Delivery. An order number will also be awarded. These terms and conditions are considered fully accepted by the Customer. Similarly, any provision amending or supplementing the general conditions of sale shall be considered fully accepted by the Customer if no written protest of the latter within 48 hours from receipt of order acceptance.

Every effort has been made to ensure the accurary of the information presented on the site "Flakesresin". The company "BRASE ARC" online store "Flakesresin" or its suppliers however are not responsible for the conséquences, incidents, special damages arising from electronic transmission or the accuracy of information provided even if the company "BRASE ARC" was aware of the possibility of such damages.

Delivery

1. In the absence of special stipulation, products are delivered within fifteen working days from the day of receipt of the order by the online store "Flakesresin" as defined in section 3 below. The Delivery times indicated by the company "BRASE ARC" are indicatice only. The non-respect of those terms cannot be the base for order cancellation or compensation. Any penalty clause included by the client in his order, shall not be applicable (Article 1 of these Terms and conditions).

2. The time limits specified in paragraph 1 of this artcle shall not apply to sales that exceed 100 euros. In this case the products listed in the price list of "BRASE ARC" will be delivered no later than within thirty days from the date of acceptance of the order by the Company "BRASE ARC" as defined in Article 3 below. If exceeded more than seven days, the Customer will benefit from a period from a period of sixty days from the date indicated by Delivery, to exercise its right of termination in accordance with the law of January 18, 1992.

3.Delivery shall be deemed made as of the availability of the product to the Customer by the carrier, materialized by the Delivery of a Delivery note signed by the client. It is for the recipient to check the parcels on arrival and to make all reserves and complaints which would appear justifies; these should be sent to the carrier by registered mail with return receipt within three working days of Delivery of products, and a copy send to the Company "BRASE ARC" online store "Flakeresin".

4. Shipping costs are borne by the Customer. Being vary according the type of command, they will be shown on the quote above order.

5. We chose DPD for shipment to France for their quality of service, speed and multiple choices of services. You can find their terms ans conditions on thier website, www.dpd.fr.

Retention of title

Ownership of goods is trnasferred to the buyer after full payment, including its accessories, whatever the mide and terms of payment used. Non-payment, total or partial, of a bill may reslut in claims of ownership of goods and BRASE ARC is entitled to proceed immediately to take back the goods to the amount remained unpaid.

Right to retract

The right of withdrawal applies only to individuals.

In accordance with Articles L. 120-20, the Customer has a period of seven (7) calendar days to return, at its expense, the products that do not suit him. This period starts from the date of receipt of the Customer order. All returns will be reported prior to our Customer service. The product should be returned to the following address :

Blended flakes can neither be returned nor exchanged due to the specificity of the preparation.

Only products returned will be together, in their original packaging complete and intact and in perfect condition for resale will be accepted. Any product that has been damaged or whise original packaging has benn damaged will not be refunded or exchanged. This right of withdrawal is without penalty, except for cost of shipping and return. In the event of exercising the right of withdrawal, the Customer has the option of requesting either a refund of amounts paid, or exchange, the Delivery will be at the expense of the Customer ...

In case of exercising the right of withdrawal, the company "BRASE ARC" will make every to refund the Customer within thirty days following the effective return of the products in its premises.

Protection of personal data

All the data you entrust to us are in order to process your orders. Under Law no. 78-17 of January 6, 1978 relating to data, files and liberties, you have with the company "BRASE ARC" online store "Flakesresin" a right of correction, consultation, modify and delete data you have provided. This right may also be exercised by sending a request by email.

Disputes

All orders placed through "Flakesresin" won the support of the Customer, without any restriction, the terms and conditions of Flakesresin.

In case of sale to a corporation, any disputes concerning the sale (price, CHV, product...) will be subject to French law before the Commercial Court of EVREUX.

Applicable law and competent court

The terms and conditions are subject to all of their stipulation to French law. Any disputes concerning the interprétations or execution of these terms and conditions of sale and any contract between a cleint company "BRASE ARC" will be the exclusive jurisdiction of the Commercial Court of EVREUX;
